As a result, the administration\u2019s decision to early terminate parole and related work authorization is in effect while the court case continues. <span style=\"text-decoration: underline;\">However, people who have a lawful basis, for example a pending asylum claim, may be able to remain in the U.S.<\/span> It is important that anyone in CHNV parole status immediately consult with a trusted immigration attorney.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a601475 elementor-widget elementor-widget-heading\" data-id=\"a601475\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"whatis\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">What is the CHNV parole program?<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8f899f2 elementor-widget elementor-widget-text-editor\" data-id=\"8f899f2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The Biden-era parole program for Venezuelans and their immediate family members was announced in October of 2022. On January 6, 2023, the Biden administration announced a similar process by which Cubans, Haitians, Nicaraguans, and their immediate family members could use a legal mechanism, known as \u201chumanitarian parole,\u201d to come to the U.S. for a period of two years to live and work lawfully if they had a sponsor in the U.S. and passed a background check. Approximately 532,000 individuals were granted humanitarian parole pursuant to the program and related work authorization.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-94d70c7 elementor-widget elementor-widget-heading\" data-id=\"94d70c7\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"currentstatus\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">What is the current status of the CHNV parole program?<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-82192b1 elementor-widget elementor-widget-text-editor\" data-id=\"82192b1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>On January 20, 2025, Trump signed an Executive Order, \u201c<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/securing-our-borders\/\" target=\"_blank\" rel=\"noopener\">Securing Our Borders<\/a>,\u201d specifically calling for an end to the CHNV parole program.<\/p><ul><li>On March 25, DHS issued a <a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/03\/25\/2025-05128\/termination-of-parole-processes-for-cubans-haitians-nicaraguans-and-venezuelans\" target=\"_blank\" rel=\"noopener\">Federal Register<\/a> notice formally terminating the CHNV parole processes\u2013 terminating the program and parole for those who entered via the CHNV parole program.<\/li><li>On April 14, a federal judge put on <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.281389\/gov.uscourts.mad.281389.97.0_3.pdf\" target=\"_blank\" rel=\"noopener\">hold<\/a> the administration\u2019s efforts to early terminate CHNV, allowing CHNV parolees to continue having protection from deportation and work authorization.<\/li><li>On May 30, the Supreme Court\u2019s <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24a1079_p86b.pdf\" target=\"_blank\" rel=\"noopener\">decision<\/a> removed the lower court\u2019s block and allowed the administration to early terminate CHNV parole and related work authorization.<\/li><li>On June 6, DHS published an <a href=\"https:\/\/www.uscis.gov\/newsroom\/alerts\/litigation-related-update-supreme-court-stay-of-chnv-preliminary-injunction\" target=\"_blank\" rel=\"noopener\">alert<\/a> indicating it \u201cmay proceed with terminating\u201d CHNV parole and revoking related work authorization and that individuals \u201cwill receive notification in their myUSCIS account.\u201d<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-09ce239 elementor-widget elementor-widget-heading\" data-id=\"09ce239\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"earlytermination\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">What does early termination of the CHNV parole program mean?<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d2058b5 elementor-widget elementor-widget-text-editor\" data-id=\"d2058b5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li>For those who entered the U.S. pursuant to the CHNV parole processes, <strong>their parole will end<\/strong>, unless a court decision states otherwise.<\/li><li><strong>Related employment authorization of CHNV parolees (granted under the c(11) category) will also end (as detailed in the revocation notice DHS will send to individuals)<\/strong>, unless individuals have gained or applied for another status that provides work authorization, such as a pending asylum application.<\/li><li>Parolees without a lawful basis to remain in the U.S. following this termination of CHNV parole will be told to depart the U.S. <br \/><ul><li>Generally, if an individual has applied for other forms of immigration relief, such as TPS or asylum, they may be able to remain in the U.S. <\/li><li><a href=\"https:\/\/iamerica.org\/legal-help\/\"><strong>Please consult with a trusted immigration attorney for more information.<\/strong><\/a><\/li><\/ul><\/li><li><strong>DHS has stated that it intends to prioritize deportation for CHNV parolees who do not depart the U.S. and have no legal basis to remain in the U.S.<\/strong> Those with a legal basis to remain in the U.S. are generally those who have filed for (or were the beneficiary of) other forms of immigration relief that would allow them to remain in the U.S. following the termination of their parole.<\/li><li>It&#8217;s clear that ICE is counting on CHNV parolees &#8220;self deporting&#8221; since ICE does not have the capacity to seek and deport more than 500,000 parolees. <\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1035904 elementor-widget elementor-widget-heading\" data-id=\"1035904\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"whatifmyemployer\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">What if my employer asks me to prove my work authorization? <\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b7b9238 elementor-widget elementor-widget-text-editor\" data-id=\"b7b9238\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"text-decoration: underline;\"><strong>Currently, it is unclear how an employer would be informed that a CHNV parolee has received notification (through a myUSCIS account) that DHS has revoked their CHNV-related work authorization.<\/strong><\/span> However, if the employer does know that USCIS has issued the CHNV parolee the legally-required notice of the revocation of their work authorization, for example, if an E-Verify employer receives notice of such revocation via the E-Verify system, employers will be allowed to reverify the work authorization of any CHNV parolee employees [EAD category c(11)].<br \/><ul><li style=\"font-weight: 400;\" aria-level=\"1\">Any CHNV parolee who has applied for other immigration relief may be authorized to work pursuant to those pending applications, such as TPS or asylum, and may provide their employers proof of other forms of employment authorization to update their records. <\/li><\/ul><\/li><li style=\"font-weight: 400;\" aria-level=\"1\">If you are represented by a union, contact your Union Representative. <\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d619f7f elementor-widget elementor-widget-heading\" data-id=\"d619f7f\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"whatdoido\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">What do I do if my work authorization and CHNV parole status has ended?<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f3ae3c8 elementor-widget elementor-widget-text-editor\" data-id=\"f3ae3c8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li><b>If you are a union member, contact your Union Representative.<\/b>\u00a0Your union can bargain with your employer for an unpaid leave of absence, severance pay, or other separation benefits.<\/li><li><strong>Contact a trusted immigration attorney immediately.<\/strong> Beware of \u201cnotarios\u201d or scammers. <a href=\"https:\/\/iamerica.org\/legal-help\/\">Find a reputable legal service provider near you.<\/a><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e88d85c elementor-widget elementor-widget-heading\" data-id=\"e88d85c\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"status\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">What is the status of the pending legal challenge to this termination? <\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7bf63dd elementor-widget elementor-widget-text-editor\" data-id=\"7bf63dd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In late February, 11 individuals\u2013 eight who entered the U.S. through a humanitarian parole program and three sponsors\u2013 and the Haitian Bridge Alliance sued the administration challenging the termination of humanitarian parole programs, including the CHNV program. The lawsuit also challenges the administration\u2019s order to pause processing on pending parole applications and any other alternative forms of relief applicants may qualify for, such as asylum and TPS. Plaintiffs are being represented by the Justice Action Center and Human Rights First. That case is Svitlana Doe v. Noem, 1:25-cv-10495 (D. Mass.).<\/p><p>On May 29, a federal judge ordered DHS to continue processing applications such as re-parole, employment authorization, family immigration and other immigration applications for individuals who were paroled into the U.S. from Ukraine and Afghanistan, the CHNV countries, and those who were part of the Central American minors program and the Military Parole-in-Place program. <strong>At this time, it is unclear if the Supreme Court\u2019s May 30 order applies to the individuals who received parole under these other programs.<\/strong> Asylum applications may still be filed. The federal judge has not yet ruled on the merits of this case\u2013 on whether the administration is legally allowed to early terminate the CHNV, and other, parole programs. This question continues before the court.
