By the end of June or early July 2026, the U.S. Supreme Court is expected to rule on the Trump administration’s efforts to end Temporary Protected Status (TPS) for Haitian and Syrian nationals. If the Court rules in favor of the administration, 350,000 Haitian and 6,000 Syrian community members will lose their ability to live and work legally in the U.S. and become vulnerable to deportation. The ruling could also determine the future of individuals with TPS for currently-designated countries.
It is important that anyone with TPS immediately consult with a trusted immigration attorney.
What is the status of TPS for Haiti and Syria?
TPS for Haiti and Syria are currently valid for now, until the U.S. Supreme Court makes a decision on whether the federal courts have the power to review DHS decisions regarding the designation/termination of TPS. The U.S. government tried to end TPS for Haiti on February 3, 2026 and end TPS for Syria on November 21, 2025. The U.S. Supreme Court heard arguments in the respective lawsuits, Trump v. Miot 그리고 Mullin v. Doe, on April 29, 2026, and is expected to make a decision by the end of June or early July 2026, which could very well mean a huge loss for Haitian and Syrian TPS holders.
I am a Haitian or Syrian TPS holder. How could a negative decision at the Supreme Court impact me?
A negative decision at the Supreme Court on TPS for Haiti and Syria would mean:
- Loss of protection from deportation/ ability to lawfully remain in the U.S.: If the Supreme Court decides TPS decision-making cannot be reviewed by the courts, this would be a loss for more than 350,000 Haitian and 6,000 Syrian community members. You could immediately lose your ability to live and work legally in the U.S. and protection from deportation.
- Lack of work authorization: You would also lose work authorization, unless you are authorized to work pursuant to other immigration relief, such as a pending application for asylum.
- Vulnerable to arrest and deportation: You could become vulnerable to return to unsafe conditions in your home country, unless you have another lawful means to remain in the U.S., such as a pending asylum application.
- Generally, if an individual had applied for other forms of immigration relief, like asylum, they may be able to remain in the U.S.

I am a TPS holder from one of the other currently-designated countries. Could this decision impact me too?
A negative decision at the U.S. Supreme Court on TPS for Haiti and Syria could also determine the future of other TPS-designated countries, as the administration is asking to make TPS decision-making unreviewable by the court system. If the Supreme Court finds the courts cannot review DHS TPS decision-making, this would impact all the lawsuits currently challenging TPS terminations plus all future TPS terminations. It would allow DHS to make TPS decisions without accountability and could potentially also mean loss of TPS and work authorization for other TPS holders.
How can I prepare for the potential loss of TPS and work authorization?
There are various steps you can take NOW to prepare for the loss of TPS and work authorization:
- Consult with a reputable immigration attorney IMMEDIATELY: You could immediately lose your ability to live and work legally in the U.S. and protection from deportation. As such, it is crucial that you seek legal advice if you have questions about your TPS and how this may impact you and your family. (See more below.)
- If you are represented by a union, contact your union representative: Your union can bargain with your employer for an unpaid leave of absence, severance pay, other separation benefits, or may have additional resources.
- Make a family safety plan: Family preparedness plans are critical to ensuring that your family is prepared for and protected in case of any immigration emergency. Now is the time to prepare a family safety plan. It can ensure that if ICE detains your or a family member, your children, other dependents, or assets are cared for. You should gather important paperwork, make sure a trusted person is listed on school records to pick-up your children from school, work out childcare and financial issues, and keep the phone numbers of an attorney and your union representative, if you are represented by a union, with you.

- You continue to be authorized to work until the Supreme Court issues its decision at the end of June or early July.
- If the Supreme Court decision immediately terminates TPS and work authorization for Haitians and Syrians, employers will be allowed to reverify work authorization of any Haitian and Syrian TPS holder- EAD categories (a)(12) and (c)(19) – and will be allowed to ask you to show proof that you are authorized to work.
- Nonetheless, any TPS holder who has applied for other immigration relief may be authorized to work pursuant to those pending applications, such as an asylum application, and you may provide your employers proof of other forms of employment authorization to update your records.
- If you are represented by a union, contact your union representative.
What do I do if my work authorization and TPS end?
