Ending on April 7, 2025 for Certain Venezuelans
On February 5, 2025, DHS published a 연방 기관지 공지 revoking the extension of Temporary Protected Status (TPS) for Venezuelans who entered the U.S. as of July 31, 2023. For Venezuelans who currently hold TPS who entered as of July 31, 2023 (pursuant to the 2023 designation), their TPS will end on April 7, 2025. (On January 10, 2025, the Biden DHS had extended this 2023 designation of Venezuelan TPS through October 2, 2026.)
For current TPS holders who have lived in the U.S. since July 31, 2023, their TPS and related work authorization will end on April 7, 2025, unless a court decision states otherwise.
For current TPS holders who have lived in the U.S. on or before March 8, 2021, TPS remains in effect (pursuant to the 2021 designation) until September 10, 2025. This designation is scheduled to be reviewed at least 60 days before expiration, on July 12, 2025.
For current TPS holders who have lived in the U.S. since July 31, 2023, their TPS- related work authorization remains valid, but will end on April 7, 2025 unless a court decision states otherwise. Previously granted automatic extensions of work authorization through April 2, 2026, have been rescinded.
For current TPS holders who have lived in the U.S. on or before March 8, 2021, TPS-related work authorization remains valid through September 10, 2025. Previously granted automatic work authorization extensions through March 10, 2025, also remain valid. However, automatic extensions through April 2, 2026, have been rescinded.
For all current Venezuelan TPS holders, USCIS will not accept and has stopped processing re-registration applications and related work authorization applications pursuant to the Biden-era extension; invalidated work permits, approval notices, and any other TPS- related documentation issued with the Biden-era expiration date of October 2, 2026; and USCIS should be refunding any fees already paid.
For current TPS holders who have lived in the U.S. since July 31, 2023: If your employer asks, you can show them the February 5, 2025, Federal Register Notice, stating TPS-related work authorization (pursuant to the 2023 designation) is valid through April 7, 2025; your current work permit or the receipt notice you received when you timely applied for a new work permit (Form I-797, Notice of Action).
For current TPS holders who have lived in the U.S. on or before March 8, 2021: If your employer asks, you can show them the October 3, 2023, Federal Register Notice (stating TPS-related work authorization pursuant to the 2021 designation is automatically extended through March 10, 2025); your expired work permit or the receipt notice you received when you applied for a new work permit (Form I-797, Notice of Action); receipt notice showing your TPS re-registration was timely filed between January 10, 2024 – March 10, 2024; Feb. 5, 2025 FRN, stating that the 2021 designation remains valid until at least September 10, 2025.
Yes, on February 19, 2025, the National TPS Alliance and several TPS recipients filed a lawsuit against the current administration in the U.S. District Court, Northern District of California, San Francisco Division, challenging the termination of TPS for Venezuelans who entered the U.S. as of July 31, 2023. There have been no further developments, but please stay tuned for updates.
The plaintiffs are represented by the American Civil Liberties Union Foundation of Northern California, the American Civil Liberties Union Foundation of Southern California, the National Day Laborer Organizing Network, and the Center for Immigration Law and Policy at University of Los Angeles School of Law. The case is National TPS Alliance v. Noem, N.D. Cal., No. 3:25-cv-01766.
As it stands now, individuals who have valid TPS may still apply for and travel on advance parole– permission to travel outside of the U.S. before traveling. However, TPS holders should consult with a reputable legal service provider to discuss the potential for increased travel risks in the current climate.
