While we know the U.S. government will now be allowed to end TPS for Haiti and Syria, the exact timing of when the terminations will go into effect, and TPS holders from Syria and Haiti will lose protections, is yet to be seen. The U.S. Supreme Court decided that federal courts do not have the power to review DHS TPS-decision making, ruling in favor of the Trump administration’s efforts to end TPS for individuals from Haiti and Syria in the cases, Trump v. MiotMullin v. Doe. Next, the Supreme Court will send the decision to the lower courts that blocked TPS from ending for Haiti and Syria and the government will very likely ask the lower court to dismiss the case, meaning the administration would be allowed to terminate TPS for Haiti and Syria.

This decision means TPS holders from Syria and Haiti will soon:

  • Lose work authorization: You will also lose work authorization, unless you are authorized to work pursuant to other immigration relief, such as a pending application for asylum.
  • Become vulnerable to arrest and deportation: You could become vulnerable to return to unsafe conditions in your home country, unless you have another lawful means to remain in the U.S., such as a pending asylum application.
